Evictions

 

UNCONTESTED (DEFAULT) EVICTION: INITIATE EVICTION - $199.00 flat fee. Services include drafting and filing a summons and complaint along with a motion to set the amount of the possession bond and orders respecting the summons and possession bond. The charge does not include the filing fee and services fee for the summons and complaint (Filing fees are as follows: less than $2,000.00 owed = $50.00; $2,001.00+ owed = $95.00. Services fees are based on $15.00 plus mileage, which usually equates to a charge of approximately $40.00. Both the filing and service fees are to be paid up front). This fee also does not include the cost of the possession bond or service of the eviction notice (the cost for service of an eviction notice (3-Day or other) is $40.00).

CONTESTED EVICTION: COMPLETE EVICTION - $499.00 flat fee. Services include those stated in sub paragraph a, above, and also include appearing at the pre-trial hearing, and preparation of the writ of restitution and judgment. The fee does not include service of the writ of restitution by the constable or lock out by the constable (The Sheriff or Constable’s fees are governed by state statute. $15.00 per document served, plus mileage for up to three trips to the property at the rate of $1.50 per mile. The service fee for the Writ of Restitution is $50.00 plus $1.50 per mile for up to three trips). If a trial is required in order to evict the tenant, the hourly rate will be $125.00 per hour for trial preparation and for attending the trial.

  1. A discretionary premium may be added by the law firm to the flat rate charges in consideration of the complexity and difficulty of the matter or in consideration of greater than average time allocation to the case.
  2. Client may upgrade their eviction service from Initiate Eviction to Complete Eviction by paying an additional $300.00 plus fees for service of process or lock as charged by the sheriff or constable.
  3. The hourly rate on services outside of the flat rate eviction services listed above shall be $125.00.

BANKRUPTCY LIFT OF STAY MOTIONS (UNCONTESTED) - $500.00 flat fee, plus costs (the filing fee for a Lift of Stay Motion is $150.00). Services include drafting of the Motion for Lift of Stay and the Order regarding the Motion for Lift of Stay. Hearings on the Motion for Lift of Stay will be billed at a rate of $125.00 per hour.
